This website is operated by Conseil AvenaCredit Inc., doing business as AvenaCredit (“AvenaCredit,” “we,” “us” or “our”), a corporation incorporated under the Canada Business Corporations Act, with its business address at 730 Merry Sud, Magog, Québec J1X 5C4, Canada.
By accessing or using avenacredit.com (the “Site”), you agree to these Terms of Use. If you do not agree, please do not use the Site.
These Terms govern your use of the Site only. If you purchase an AvenaCredit membership, your rights and obligations as a member are set out in the Membership Agreement, which includes the Payment Plan Disclosure and, where you pay by Canadian bank account, the Pre-Authorized Debit Agreement. Where these Terms and the Membership Agreement conflict on a matter concerning your membership, the Membership Agreement governs.
1. Who may use the Site
The Site is intended for residents of Canada who have reached the age of majority in their province or territory of residence. Membership in AvenaCredit is available only to Canadian residents who meet the eligibility requirements in the Membership Agreement. The Site is not directed at children, and we do not knowingly collect personal information from anyone under the age of majority.
2. Permitted use
You may use the Site for your own personal, non-commercial purposes: reading our guides and articles, comparing plans, contacting us, and enrolling in or managing a membership.
You agree not to:
- use the Site for any unlawful purpose, or in a way that infringes the rights of others;
- impersonate another person, or provide false, inaccurate or misleading information;
- scrape, harvest, crawl or use automated means to extract content, except for search engines and AI crawlers operating in accordance with our robots.txt file;
- copy, republish, resell or redistribute substantial portions of the Site’s content without our written permission;
- reverse-engineer, decompile, probe or test the vulnerability of the Site or any related system;
- introduce malware, attempt unauthorized access, or interfere with the Site’s operation or security; or
- use the Site to transmit unsolicited commercial messages.
3. Accounts and security
If you create an account, you are responsible for keeping your credentials confidential and for all activity carried out under your account. Notify us at info@avenacredit.com promptly if you suspect unauthorized access. We may suspend or close an account where we reasonably believe it is being used in breach of these Terms or the Membership Agreement.
4. Educational content is not advice
The guides, articles, calculators, checklists and other educational material on this Site are general information about credit in Canada. They are not legal, tax, accounting, insolvency, investment or individualized financial advice, and they do not take your personal circumstances into account.
Credit rules, bureau practices, lender criteria and provincial legislation change. We aim to keep the Site accurate and current, but we do not warrant that every statement is complete, current or applicable to your situation. Before making a financial decision, consider consulting a licensed professional, and verify anything that matters against your own Equifax credit report.
5. No guarantee of credit outcomes
AvenaCredit does not represent, warrant or guarantee that your credit score, credit rating, credit file or creditworthiness will improve by any amount, within any timeframe, or at all. Any figures shown on the Site, including average point changes, are averages or illustrations and are not promises of individual results. AvenaCredit is not a credit repair organization and does not remove accurate information from a credit file.
6. Pricing and product information
We aim to keep prices, plan features and availability accurate on the Site. Occasional errors, omissions or out-of-date information may occur, and we reserve the right to correct them. The terms that apply to your membership are those disclosed to you at the time of enrollment and set out in the Membership Agreement and your Payment Plan Disclosure, not any conflicting figure that may appear elsewhere on the Site.
7. Intellectual property
The Site and its content — text, guides, articles, graphics, layout, design, logos, the AvenaCredit name and brand, software and other material — are owned by AvenaCredit or its licensors and are protected by Canadian and international intellectual property laws.
You may read, print and share individual pages for your own personal, non-commercial use, and you may quote short excerpts with attribution and a link to the source page. All other use, including systematic copying, republication, adaptation or commercial use, requires our prior written permission.
8. Content you submit
If you send us feedback, questions, suggestions or other material through the Site or by email, you grant AvenaCredit a non-exclusive, royalty-free, worldwide licence to use it for the purpose of operating and improving our services, without obligation to compensate you. Do not send us confidential information you do not want us to use, and do not send personal information about other people without their consent.
9. Links to other websites
The Site links to third-party sites, including Equifax Canada, government and regulatory bodies, and other organizations. Those sites are not under our control. We provide the links for convenience and do not endorse, and are not responsible for, their content, accuracy, products, services or privacy practices. Review the terms and privacy policy of any third-party site you visit.
10. Availability of the Site
We aim to keep the Site available, but we do not guarantee uninterrupted or error-free access. We may suspend, withdraw or restrict all or part of the Site for maintenance, security, technical or business reasons, generally without notice. We are not liable to you if the Site is unavailable at any time or for any period.
11. Privacy
Our collection, use, disclosure, retention and protection of personal information is governed by our Privacy Policy, which is designed to comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and Québec’s Act respecting the protection of personal information in the private sector, as amended by Law 25. Credit-file access and credit reporting are additionally governed by the credit bureau reporting consent presented during enrollment.
12. Disclaimers
To the maximum extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
Nothing in these Terms excludes or limits any warranty, condition, right or remedy that cannot legally be excluded or limited under applicable consumer protection legislation in your province or territory.
13. Limitation of liability
To the maximum extent permitted by law, AvenaCredit and its directors, officers, employees and service providers are not liable for any indirect, incidental, consequential, special, exemplary or punitive damages, or for lost profits, lost opportunities, lost data, or expected credit outcomes, arising out of or relating to your use of the Site.
To the maximum extent permitted by law, our total aggregate liability arising from your use of the Site, other than in connection with a membership governed by the Membership Agreement, is limited to $100 CAD.
These limitations do not apply where prohibited by law, including to liability that cannot legally be limited under applicable consumer protection legislation.
14. Your responsibility
To the maximum extent permitted by law, you are responsible for third-party claims arising directly from your intentional fraud, your unlawful misuse of the Site, or your knowing provision of materially false information. This Section does not require a consumer to indemnify AvenaCredit for AvenaCredit’s own fault where such an obligation would be prohibited or unenforceable.
15. Suspension of access
We may restrict or terminate your access to the Site, without notice, if we reasonably believe you have breached these Terms, created a security or fraud risk, or used the Site unlawfully. Termination of Site access does not by itself terminate a membership or affect amounts owing under the Membership Agreement.
16. Changes to these Terms
We may update these Terms from time to time to reflect changes in our practices, our services, technology or the law. The current version is always posted on this page with a “last updated” date. Your continued use of the Site after a change takes effect constitutes acceptance of the updated Terms. Where a change requires advance notice or consent under applicable law, we will comply with that requirement.
17. Governing law
These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable there, without regard to conflict-of-laws principles. Nothing in this Section deprives a consumer of the mandatory protections, or the jurisdictional rights, available to them in their own province or territory of residence.
18. Language — Québec
A French version of this Site and of our standard-form documents is made available. Where you are a Québec resident and choose to use the English version after having access to the French version, you expressly request that these Terms and related documents be drawn up in English, to the extent permitted by law. 19. Severability and entire agreement
If any provision of these Terms is found invalid or unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions remain in force. These Terms, together with the Privacy Policy, the credit reporting consent and — for members — the Membership Agreement, constitute the entire agreement between you and AvenaCredit regarding your use of the Site.
